Data Protection for Disputes Lawyers Seminar

BACFI’s seminar, entitled ‘Data Protection for Disputes Lawyers’, took place on 10 June 2015 in the Prince’s Room, Middle Temple. The seminar was chaired by James Kitching (Partner at Fried, Frank, Harris, Shriver & Jacobson LLP (London)) and took the format of a panel discussion. The panellists comprised Geraldine Dersley (Lead Solicitor and Head of Legal Profession, Information Commissioner’s Office), Robin Hopkins (Leading Barrister in Data Protection Law, 11 King’s Bench Walk), Stephen Juris (Partner, Fried Frank, Harris, Shriver & Jacobson LLP (New York)) and Michael Powders (Head of Privacy Global Functions, Vice President, Compliance, Barclays Plc).
The seminar commenced with Robin Hopkins providing an outline of the E.U. data protection, legal framework. The panel then discussed a number of specific tensions between the requirements of E.U. data protection law, and, the obligations on entities to give disclosure in cross-border legal proceedings and in response to document production requests from overseas enforcement bodies. The panel also considered the impact of some recent events on the E.U. framework, including the case of Max Schrems v. Data Protection Commissioner and its potential bearing on Safe Harbour. The panel benefited from a knowledgeable and engaged audience consisting of lawyers from a number of jurisdictions, culminating in a lively discussion offering a number of different perspectives.
